Socrates Club Discussion “Makarashvili and others v. Georgia”

The Human Rights Department of the School of Law of Ilia State University invites you to a discussion, organized by the Socrates Club with the support of the USAID Rule of Law Program, which will review the decision “Makarashvili and others v. Georgia” of the European Court of Human Rights on January 20, at 19:00.
The case concerns the administrative arrest of three citizens during the November 18, 2019 demonstrations and their imprisonment. The court assessed whether this decision violated Articles 11 (right to assembly and demonstrate) and 6 (right to a fair hearing) of the European Convention.
The appellants argued that due to the absence of a prosecutor in the process of administrative-law violations, the trial judge combined the prosecutor's function due to which the process became biased. In this regard, the principle of equality of the parties was assessed. One of the appellants in the case also had to plead his innocence, raising questions about the protection of the presumption of innocence.
The Socratic method of discussion will be used at the meeting, which will help us analyze the problem and find ways to solve it. The reasoning aims to analyze the decision in terms of human rights.
At the end of the semester, the 3 most active (activity is calculated by the number of signatures on the attendance sheet) students, who attended the events organized by the Human Rights Department, will be identified and awarded by the Dean of the School of Law.
